The employment-based immigrant visa popularly known as EB-3 Program leads to U.S. permanent residence or a green card. It is also referred to as the employment third preference visa category. It's available to three categories of people: skilled workers, professionals, and unskilled workers.  Like other green cards, EB-3 gives you and your family (spouse and unmarried children below 21 years) permanent residency and grants access to the U.S. education system, the right to live, retire, work and study in the USA.

EB-3 Visa Program was established by the Immigration Act of 1990. Since then, corporations in the United States have been able to sponsor foreign nationals who are willing and qualified to work in these roles. The EB-3 visa requirements are relatively less stringent than other employment-based visas (EB-1/EB-2). This is offered for those positions for which qualified workers are not available in the United States.

The most critical part of the process is to find a qualified U.S. employer who can sponsor you for the EB-3 visa offering a full time job. EB-3 Skilled Workers 

You must be able to demonstrate that you possess at least 2 years of job experience, education, or training that meets the job requirements specified on the labor certification.
Relevant post-secondary education may be considered as training.

You must demonstrate that you possess a U.S. baccalaureate or foreign equivalent degree, and that a baccalaureate degree is the normal requirement for entry into the occupation. Education and experience may not be substituted for a baccalaureate degree. You must also meet any other requirements specified on the labor certification.

THE Most Popular

The EB-3 ‘Other Workers’ sub-category has been created for people who are seeking employment in unskilled position. As more businesses than ever are facing difficulties to find employees for the unskilled positions, the US government allocates 10,000 EB-3 visas each year for unskilled workers to minimize labor shortage.

You must demonstrate the ability to perform unskilled labor. The job positions that require less than two years of training and not seasonal in nature are classified as unskilled and fall under the ‘Other Workers’ sub-category. You must also meet any other requirements

if specified on the labor certification.

Find the employer & get approval from the Department of Labor 

VISA PETITION (I-140) FILING TO
US CITIZENSHIP & IMMIGRATION SERVICES (USCIS)

Our team will engage with you to understand your preference, match employer of your choice, arrange job interview with the employer and then facilitate labor certification process with your help. Visa petition (I-140) filing to U.S. Citizenship & Immigration Services

After getting approval from the DoL, your employer submits a visa petition on your behalf using Form I-140 to U.S. Citizenship and Immigration Services (USCIS). We make sure that you employer files petition on-time with accurate information and submits all valid documents as per requirement of USCIS.

Submit application for Immigrant Visa to the National Visa Center

Once I-140 petition is approved, you may need to wait until a visa is available based on the date the labor certification application was filed (your priority date). You can track your priority date's progress by following the State Department's Visa Bulletin. When your priority date becomes current, immigration visa application has to be submitted individually for you and your eligible family members to the NVC. Our experienced U.S. Federal Immigration Attorney will assist you to submit your immigration visa application.

Interview at local embassy or USCIS office & get your visa approved 

When your immigration visa application is approved, you need to face an interview at local U.S. Embassy or USCIS office. You need to do medical check-up as prescribed by the local embassy before the interview. A successful interview leads to a visa stamped in your passport and you can move to the USA. EB-5 INVESTMENT IMMIGRANT PROGRAM

The EB 5 visa, also known as ‘Investor Green Card’ provides permanent U.S. residency to immigrant investors who invest capital worth US $1,000,000 or $500,000 in high unemployment or rural area. This investment must create at least 10 full-time jobs for U.S. citizens, lawful permanent residents, or other immigrants authorized to work in the United States excluding the investor and his family members.

 

The EB-5 Green Card is generally granted faster for the investor and eligible family members i.e. spouse and unmarried children below 21 years. As lawful permanent residents, family members are authorized to work or study in the U.S.  The investor must reside in the USA for 6 months per year.
